Proposal for a

REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL

laying down management, conservation and control measures applicable in the Convention area of the North Pacific Fisheries Commission

EXPLANATORY MEMORANDUM

1.CONTEXT OF THE PROPOSAL

•Reasons for and objectives of the proposal

This proposal aims to implement the conservation and management measures (CMMs) adopted by the North Pacific Fisheries Commission (NPFC) under the Convention on the Conservation and Management of High Seas Fisheries Resources in the North Pacific Ocean (the Convention). The NPFC is the regional fisheries management organisation (RFMO) responsible for managing fishery resources in the Convention area.

The NPFC has a mandate to adopt CMMs for the fisheries within the scope of the Convention.

The EU has been a member of the NPFC since 2022. From April 2024, the NPFC allocated to the Union fishing opportunities for chub mackerel. The EU can authorise one fishing vessel in the Convention area.

Under Article 9(1) of the Convention, CMMs adopted by the NPFC Commission are binding on members of the NPFC, unless an objection is raised. Each Member must ensure compliance with and enforcement of such measures.

This proposal covers the measures that the Meeting of the Parties has adopted since 2015, as amended (in some cases) at its subsequent annual meetings, that need to be implemented in regard to the fishing activities of EU vessels undertaking midwater trawling for chub mackerel. As soon as NPFC measures enter into force, the EU must ensure compliance with these measures, as international obligations.

This proposal is designed to implement current NPFC measures and to set up a mechanism for implementing future measures.

This proposal aims to ensure that the EU can quickly: (i) implement measures that concern the EU fleet; (ii) ensure a level playing field for operators; and (iii) further support the long-term sustainable management of stocks. In order to swiftly implement NPFC rules, this proposal also provides for delegated powers to be granted to the Commission under Article 290 TFEU in order to cater for amendments to NPFC measures, as well as, to ensure that EU fishing vessels are on an equal footing so rules are the same as those of other Contracting Parties. Delegated powers empower the Commission to adopt delegated acts in relation to chub mackerel catch reporting, automatic transmission of the vessel monitoring system, duties of the fisheries management centre, technical specifications of tracking devices, reporting timing and location distances, monitoring and reporting of transhipment, including regional observer programme, obligations of the master of the fishing vessels during high seas boarding and inspection, rights of observers, list of alleged serious violations during an inspection procedure of, list of alleged serious violations received from another NPFC Member, reporting obligations for fishing activities, references to NPFC documents to be used by EU Member States in relation to vessel marking and annual catch reports.

•Consistency with existing policy provisions in the policy area

This proposal complements and is generally consistent with other provisions of Union law in this area. Technical derogations from existing acts for vessel monitoring scheme and transhipment at sea are however established in certain instances due to the nature of the more specific measures proposed.

This proposal is in line with Part VI (External Policy) of Regulation (EU) No 1380/2013 on the common fisheries policy (CFP), which provides for the EU to conduct its external fisheries in line with its international obligations in regional fisheries cooperation.

The proposal complements Regulation (EU) 2017/2403 on external fleet management, which provides that EU fishing vessels are subject to the list of fishing authorisations under the conditions and rules of the RFMO in question, and Council Regulation (EC) No 1005/2008 on illegal, unreported and unregulated (IUU) fishing as amended by Regulation (EU) 2023/2842 of the European Parliament and of the Council of 22 November 2023.

This proposal does not cover fishing opportunities for the EU, as decided by the Meeting of the Parties of the NPFC. Under Article 43(3) TFEU, it is for the Council to adopt measures on prices, levies, aid and quantitative limitations, and on the fixing and allocation of fishing opportunities.

•Consistency with other Union policies

Not applicable.

2.LEGAL BASIS, SUBSIDIARITY AND PROPORTIONALITY

•Legal basis

The proposal is based on Article 43(2) TFEU, as it sets out provisions needed to pursue the objectives of the CFP.

•Subsidiarity (for non-exclusive competence)

As the proposal falls under the EU's exclusive competence (Article 3(1)(d) TFEU), the subsidiarity principle does not apply.

•Proportionality

The proposal will ensure that EU law is in line with international obligations adopted by the NPFC and that the EU complies with decisions taken by an RFMO to which it is a Contracting Party, in this case the NPFC. The proposal does not exceed what is necessary to achieve these objectives.

•Choice of the instrument

The instrument chosen is a Regulation of the European Parliament and of the Council.

3.RESULTS OF EX-POST EVALUATIONS, STAKEHOLDER CONSULTATIONS AND IMPACT ASSESSMENTS

•Ex-post evaluations/fitness checks of existing legislation

Not applicable.

•Stakeholder consultations

The purpose of this proposal is to implement NPFC measures that are binding on the Contracting Parties. National experts and industry representatives from the EU countries are consulted both during the run-up to the annual Meeting of the Parties at which the measures are adopted and throughout negotiations at the meeting. Consequently, it was not considered necessary to hold a stakeholder consultation on this proposal.

•Collection and use of expertise

Not applicable

•Impact assessment

Not applicable.

•Regulatory fitness and simplification

This proposal is not linked to Regulatory fitness and performance programme (REFIT).

•Fundamental rights

This proposal has no consequences for the protection of fundamental rights.

Proposal for a

REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL

laying down management, conservation and control measures applicable in the Convention area of the North Pacific Fisheries Commission

THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article  43(2) thereof,

Having regard to the proposal from the European Commission,

After transmission of the draft legislative act to the national Parliaments,

Having regard to the opinion of the European Economic and Social Committee 1(1),

Acting in accordance with the ordinary legislative procedure,

Whereas:

(1)The objective of the Common Fisheries Policy (CFP), as set out in Regulation (EU) No 1380/2013 of the European Parliament and of the Council, is to ensure the exploitation of living aquatic resources contributes to long-term environmental, economic and social sustainability. 2 (2)

This Regulation implements for the first time, the NPFC conservation and management measures adopted between 2015 and 2026 relevant for the fishing activities undertaken by Union vessels in the Convention area.

(5)To ensure compliance with the CFP, Union legislation has been adopted to establish a system of control, inspection, and enforcement, which includes the fight against illegal, unreported, and unregulated (IUU) fishing. In particular, Council Regulation (EC) No 1224/2009 6 (6) as amended by Regulation (EU) 2023/2842 of the European Parliament and of the Council of 22 November 2023 7 (7) establishes a Union system for control, inspection and enforcement with a global and integrated approach so as to ensure compliance with all the rules of the CFP. Commission Implementing Regulation (EU) No 2025/2196 8 (8) lays down detailed rules for the implementation of Council Regulation (EC) No 1224/2009. Council Regulation (EC) No 1005/2008 9 (9) establishes a Community system to prevent, deter and eliminate IUU fishing. It is therefore not necessary to include those provisions in this Regulation.

(6)In accordance with Article 29(2) of Regulation (EU) No 1380/2013, the positions of the Union in regional fisheries management organisations are to be based on the best available scientific advice so as to ensure that fishery resources are managed in accordance with the objectives of the CFP, in particular with the objective of progressively restoring and maintaining populations of fish stocks above biomass levels capable of producing maximum sustainable yield, and with the objective of providing conditions for economically viable and competitive fishing capture and processing industry and land-based fishing related activity.

(7)In order to swiftly implement into Union law future NPFC measures amending or supplementing the ones established in this Regulation, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of the automatic transmission of the vessel monitoring system, duties of the fisheries management centre, technical specifications of tracking devices, reporting timing and location distances, monitoring and reporting of transshipment, including regional observer programme, obligations of the master of the fishing vessels during high seas boarding and inspection, rights of observers, list of alleged serious violations during an inspection procedure of list of alleged serious violations received from another NPFC Member, reporting obligations for fishing activities and , references to international duties of Member States.

(8)The delegation of powers provided for in this Regulation should be without prejudice to the implementation of future NPFC conservation and management measures into Union law through the ordinary legislative procedure.

(9)The European Data Protection Supervisor was consulted in accordance with Article 42(1) of Regulation (EU) 2018/1725 of the European Parliament and of the Council 10 (10), and delivered formal comments on . Data processed in the framework of this Regulation are to be treated in accordance with the relevant rules on the protection of personal data and confidentiality as referred to in Article 112 and 113 of Council Regulation 1224/2009 11 (11). In order to ensure the fulfilment of obligations under this Regulation, the personal data should be stored for a period of up to 10 years. In the event that the personal data are needed in order to follow up an infringement, for inspections, judicial or administrative procedures, it should be possible for those data to be stored for a period exceeding 10 years, but no longer than 20 years.

Alignment with the European Data Strategy

Explain how the requirement(s) are aligned with the European Data Strategy

This regulation aligns with the EU data strategy by fostering a data-driven approach to authorising and monitoring fishing vessels in order to implement the conservation and management measures adopted by the NPFC.

Alignment with the once-only principle

Reuses the existing UN/FLUX standards and FLUX Transportation Layer already applied under the CFP control framework. The same infrastructure and message formats can be (and in practice are) reused for other RFMOs and fisheries data exchanges, avoiding duplication of systems and formats.
