These priorities shall take account of financial constraints at both national and Community level and of the Community legal provisions governing such actions.

3. The representative of the Commission shall submit to the Committee a draft of the measures to be taken. The Committee shall deliver its opinion on the draft within a time limit which the chairman may lay down according to the urgency of the matter. The opinion shall be delivered by the majority laid down in Article 148(2) of the Treaty establishing the European Community in the case of decisions which the Council of the European Union is required to adopt on a proposal from the Commission. The votes of the representatives of the Member States within the Committee shall be weighted in the manner set out in that Article. The chairman shall not vote.

- ottaa huomioon komission ehdotuksen neuvostolle, KOM(94)0078 lop. - 94/0026(CNS) ((EYVL C 106, 14.4.1994, s. 22)),

- neuvoston kuultua sitä EY:n perustamissopimuksen 213 artiklan mukaisesti (C3-0231/94),

- katsoo, että ehdotettu oikeudellinen perusta ei ole asianmukainen; katsoo, että olisi myös viitattava EY:n perustamissopimuksen 43 ,76 ,87 ,100 , 100 a ja 113 artiklaan,

- ottaa huomioon työjärjestyksensä 58 artiklan,

- ottaa huomioon talous- ja raha-asiota sekä teollisuuspolitiikkaa käsittelevän valiokunnan mietinnön sekä oikeusasioita ja kansalaisten oikeuksia käsittelevän valiokunnan lausunnon ehdotuksen oikeudellisesta perustasta (A4-0071/95),

1. Hyväksyy komission ehdotuksen parlamentin tekemin tarkastuksin;

2. Pyytää tulla kuulluksi uudelleen, jos neuvosto aikoo tehdä huomattavia muutoksia komission ehdotukseen;

3. Kehottaa puhemiestään välittämään lausunnon neuvostolle, komissiolle ja jäsenvaltioiden parlamenteille.
