ANNEX I

TACs APPLICABLE TO UNION FISHING VESSELS
IN AREAS WHERE TACs EXIST BY SPECIES AND BY AREA

The tables in the Annexes set out the TACs and quotas (in tonnes live weight, except where otherwise specified) by stock, and, where appropriate, the conditions functionally linked thereto.

All fishing opportunities set out in the Annexes to this Regulation shall be subject to the rules set out in Regulation (EC) No 1224/2009, and in particular Articles 33 and 34 thereof.

The references to fishing zones in the Annexes are references to ICES zones, unless otherwise specified. Within each area, fish stocks are referred to according to the alphabetical order of the scientific names of the species. Only scientific names identify species for regulatory purposes.

For the purposes of this Regulation, a comparative table of scientific names and common names of the species listed in the Annexes is provided below, for ease of reference. Annexes IA to IM are part of Annex I.

Once the ‘Others’ quota is exhausted, the by-catch limits shall be as follows: a maximum of 1 250 kg or 5 %, whichever is greater.
If, however, following quota transfers or exchanges (YEL/N3LNO-DIR) or charter, directed fisheries are conducted, the following shall apply:

(a) a by-catch of 15% of American plaice is permitted. However, if a fishing vessel is carrying an observer:

(i) this maxima shall be 2 900 kg or 15 % of American plaice, whichever the greater; and
(ii) a vessel may exceed the maxima referred to in point (i) for by-catches of American plaice retained on board during the first 9 fishing days in the NAFO
Regulatory Area, provided that American plaice by-catch represents 15 % or less by the end of that period or when the vessel leaves the NAFO Regulatory Area, whichever occurs first;

(b) the first two times that catches of American plaice comprise the largest percentage by weight of the total catch in a haul, such catches shall be considered as incidental catch, but the vessel shall immediately move a minimum of 10 nautical miles from any position of the previous haul throughout the subsequent haul.

(2)

This quantity is available to NAFO Contracting Parties that have not been allocated a quota for this stock, including the Union, and in accordance with applicable NAFO measures.

(3)

Catches under this shared quota shall be reported separately (YEL/N3LNO-OTH). The fisheries under this ‘Others’ quota will be closed by NAFO Contracting Parties, including for the Union by the Commission, five calendar days after notification by the NAFO Executive Secretary that the quota is estimated to be fully utilised.

This annual TAC is only for exploratory fisheries, as defined in Article 4, point 11, of Regulation (EU) 2018/975 of the European Parliament and of the Council*. Fishing shall be limited to depths between 600 m and 2 500 m. Fishing shall be limited to one trip of a maximum duration of 60 consecutive days which may occur any time between 1 May and 15 November. All fishing shall cease immediately if the death of the following occurs:

(a)    one of any of the following species: wandering albatross (Diomedea exulans), grey-headed albatross (Thalassarche chrysostoma), black-browed albatross (Thalassarche melanophris), grey petrel (Procellaria cinerea), soft-plumaged petrel (Pterodroma mollis); or

(b)    three individuals of any of the following species: light-mantled albatross (Phoebetria palpebrata), southern giant petrel (Macronectes giganteus) and northern giant petrel (Macronectes halli).

Fishing shall further be limited to a maximum number of 5 000 hooks per set, with a maximum of 100 sets. Longlines shall be set at least 3 nautical miles apart from each other, and not set at previous longline locations within one calendar year. Fishing shall cease either when the TAC is reached or if 100 sets have been set and hauled during the trip, whichever is earlier.

*    Regulation (EU) 2018/975 of the European Parliament and of the Council of 4 July 2018 laying down management, conservation and control measures applicable in the South Pacific Regional Fisheries Management Organisation (SPRFMO) Convention Area (OJ L 179, 16.7.2018, p. 30, ELI:  http://data.europa.eu/eli/reg/2018/975/oj ).

Of which up to to be established tonnes may be fished in research block A. As the catch limit for research block A is approached, shorter lines shall be set to ensure that the catch limit is not exceeded. Catches of toothfishes in research block A shall be reported separately (TOT/SPR-A).

(4)

Of which up to to be established tonnes may be fished in research block B. As the catch limit for research block B is approached, shorter lines shall be set to ensure that the catch limit is not exceeded. Catches of toothfishes in research block B shall be reported separately (TOT/SPR-B).

(2)

The by-catch allowance set out above is not allocated between SIOFA Parties, hence the Union’s share is undetermined.

(3)

Exclusively for by-catches. No directed fisheries are permitted under this by-catch allowance. Once the by-catch allowance is exhausted, the SIOFA Secretariat will notify SIOFA Contracting Parties. On receiving that notification that the by-catch allowance has been exhausted, Member States shall ensure that their vessels fishing in SIOFA subarea 2 do not retain any Portuguese dogfish for the remainder of the year. That retention prohibition shall apply to any lines in the water following the notification of the SIOFA Secretariat that the by-catch allowance has been exhausted. Vessels with lines in the water at the time that the notification is received may retain Portuguese dogfish that are dead at time of haul and shall release all live Portuguese dogfish on such lines.
