amending Annex XXI (Statistics) to the EEA Agreement
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,
Whereas:
(1)Commission Regulation (EU) 2019/2146 of 26 November 2019 amending Regulation (EC) No 1099/2008 of the European Parliament and of the Council on energy statistics, as regards the implementation of updates for the annual, monthly and short-term monthly energy statistics 1 is to be incorporated into the EEA Agreement.
(2)Commission Regulation (EU) 2022/132 of 28 January 2022 amending Regulation (EC) No 1099/2008 of the European Parliament and of the Council on energy statistics, as regards the implementation of updates for the annual, monthly and short-term monthly energy statistics 2 is to be incorporated into the EEA Agreement.
(3)Commission Regulation (EU) 2024/264 of 17 January 2024 amending Regulation (EC) No 1099/2008 of the European Parliament and of the Council on energy statistics, as regards the implementation of updates for the annual, monthly and short-term monthly energy statistics 3 is to be incorporated into the EEA Agreement.
(4)Commission Implementing Regulation (EU) 2017/2169 of 21 November 2017 concerning the format and arrangements for the transmission of European Statistics on natural gas and electricity prices pursuant to Regulation (EU) 2016/1952 of the European Parliament and of the Council 4 is to be incorporated into the EEA Agreement.
(5)Annex XXI to the EEA Agreement should therefore be amended accordingly,
HAS ADOPTED THIS DECISION:
Article 1
Annex XXI to the EEA Agreement is amended as follows:
1.Point 26a (Regulation (EC) No 1099/2008 of the European Parliament and of the Council) is amended as follows:
i.The point is renumbered as point 26c.
ii.The adaptation text is replaced by the following:
“(a)Liechtenstein is exempted from transmitting the data required by the Regulation, except for the data of imports and exports of all energy products and the production of electricity for Annual Energy Statistics (Annex B).
(b)Iceland is exempted from transmitting the aggregates defined in Annex B “Annual Energy Statistics” relating to the detailed energy consumption breakdown by type of end-use (space heating, space cooling, water heating, cooking, lighting and electrical appliances, other end uses) of the Residential sector as it is defined in Section 2.3 “Energy end-use specification” of Annex A “Clarifications of terminology”. This exemption shall be subject to review by the EEA Joint Committee whenever data provided by Iceland demonstrate that the annual final energy consumption in the residential sector is equal to 25 000 terajoules or more.
(c)Iceland is exempted from transmitting the data required by Section 2 “Natural Gas” of Annex B “Annual Energy Statistics”. This exemption shall be subject to review by the EEA Joint Committee as soon as there are indications that gaseous or liquefied natural gas storage facilities are established on Iceland’s territory or that the annual consumption of natural gas is equal to 2 500 terajoules or more.
(d)Iceland and Norway are exempted from transmitting the data required by Section 6 “Annual Nuclear Statistics” of Annex B “Annual Energy Statistics”, as long as there are no nuclear facilities or power plants on their territory.
(e)Iceland is exempted from transmitting the data required by Section 1 “Solid Fuels” and Section 4 “Natural Gas” of Annex C “Monthly Energy Statistics”. The natural gas exemption shall be subject to review by the EEA Joint Committee as soon as there are indications that gaseous or liquefied natural gas storage facilities are established on Iceland’s territory or that the annual consumption of natural gas is equal to 2 500 terajoules or more.
(f)Iceland is exempted from transmitting the data required by Annex D “Short-Term Monthly Statistics”, as long as there are no oil refineries on its territory.”
2.The following indents are added in point 26c (Regulation (EC) No 1099/2008 of the European Parliament and of the Council):

3.The following point is inserted after point 26 (Directive 2008/92/EC of the European Parliament and of the Council):
‘26a.32017 R 2169: Commission Implementing Regulation (EU) 2017/2169 of 21 November 2017 concerning the format and arrangements for the transmission of European Statistics on natural gas and electricity prices pursuant to Regulation (EU) 2016/1952 of the European Parliament and of the Council (OJ L 306, 22.11.2017, p. 9).’
Article 2
The texts of Regulations (EU) 2019/2146, (EU) 2022/132, (EU) 2024/0264 and Implementing Regulation (EU) 2017/2169 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on […], provided that all the notifications under Article 103(1) of the EEA Agreement have been made 5*.
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
