a schengeni konzultációs hálózat módosításáról (technikai előírások)

AZ EURÓPAI UNIÓ TANÁCSA,

tekintettel a vízumkérelmek megvizsgálására vonatkozó egyes részletes rendelkezések és gyakorlati eljárások végrehajtási hatásköreinek a Tanács részére történő fenntartásáról szóló, 2001. április 24-i 789/2001/EK tanácsi rendeletre [1], és különösen annak 1. cikke (2) bekezdésére,

tekintettel a Cseh Köztársaság kezdeményezésére,

mivel:

(1) A schengeni konzultációs hálózatot annak érdekében hozták létre, hogy lehetővé tegyék a tagállamok központi hatóságai közötti konzultációt az egyes harmadik országok állampolgárai által benyújtott vízumkérelmekkel kapcsolatban.

(2) A Közösségi Vízumkódex létrehozásáról szóló, 2009. július 13-i 810/2009/EK európai parlamenti és tanácsi rendelet [2] 22. cikke módosítja az abban az esetben jelenleg alkalmazandó szabályt, ha valamely tagállam egyes harmadik országbeli állampolgárok vagy ilyen állampolgárok bizonyos kategóriái által benyújtott vízumkérelmek vizsgálata során valamely más tagállam központi hatóságait a saját központi hatóságaival való egyeztetésre kéri. A schengeni konzultációs hálózat technikai előírásait ennek megfelelően módosítani kell.

(3) A Vízumkódex 31. cikke értelmében a tagállamok megkövetelhetik, hogy – a repülőtéri tranzitvízumokat kivéve – központi hatóságaikat tájékoztassák a más tagállamok által kiadott olyan vízumokról, amelyeket egyes harmadik országbeli állampolgárok vagy ilyen állampolgárok bizonyos kategóriái számára adtak ki.

(4) Az ilyen információ továbbításához új nyomtatványt kell bevezetni a schengeni konzultációs hálózatba.

(5) A Vízumkódex alkalmazásának dátumától fogják törölni a hosszú idejű tartózkodásra jogosító vízumot, amely egyidejűleg rövid idejű tartózkodásra jogosító vízumként is érvényes ("D+C" típus), és a tranzitvízumot ("B" típus) össze fogják vonni a rövid távú tartózkodásra jogosító vízummal ("C" típus).

(6) A schengeni konzultációs hálózat technikai előírásait ennek megfelelően módosítani kell, és az a Vízumkódex alkalmazásának dátumától lesz alkalmazandó.

(7) Az Európai Unióról szóló szerződéshez és az Európai Unió működéséről szóló szerződéshez csatolt, Dánia helyzetéről szóló 22. számú jegyzőkönyv 1. és 2. cikke értelmében Dánia nem vesz részt e határozat elfogadásában, az rá nézve nem kötelező és nem alkalmazandó. Mivel e határozat a schengeni vívmányokon alapul, Dánia az említett jegyzőkönyv 4. cikkének megfelelően a Tanács e határozat elfogadására vonatkozó döntését követő hat hónapos időszakon belül határoz arról, hogy azt nemzeti jogában végrehajtja-e.

(8) Izland és Norvégia tekintetében e határozat az Európai Unió Tanácsa, valamint az Izlandi Köztársaság és a Norvég Királyság között kötött, e két államnak a schengeni vívmányok végrehajtására, alkalmazására és fejlesztésére irányuló társulásáról szóló megállapodás [3] értelmében a schengeni vívmányok azon rendelkezéseinek továbbfejlesztését képezi, amelyek az említett megállapodás alkalmazását szolgáló egyes szabályokról szóló, 1999. május 17-i 1999/437/EK tanácsi határozat [4] 1. cikkének A. pontjában említett területhez tartoznak.

(9) Svájc tekintetében e határozat az Európai Unió, az Európai Közösség és a Svájci Államszövetség közötti, a Svájci Államszövetségnek a schengeni vívmányok végrehajtására, alkalmazására és fejlesztésére irányuló társulásáról szóló megállapodás [5] értelmében a schengeni vívmányok azon rendelkezéseinek továbbfejlesztését képezi, amelyek az 1999/437/EK határozat 1. cikkének A. pontjában említett terület alá tartoznak, összefüggésben az említett megállapodásnak az Európai Közösség nevében történő megkötéséről szóló 2008/146/EK tanácsi határozat [6] 3. cikkével.

(10) Liechtenstein tekintetében e határozat az Európai Unió, az Európai Közösség, a Svájci Államszövetség és a Liechtensteini Hercegség közötti, a Liechtensteini Hercegségnek az Európai Unió, az Európai Közösség és a Svájci Államszövetség között létrejött, a Svájci Államszövetségnek a schengeni vívmányok végrehajtására, alkalmazására és fejlesztésére irányuló társulásáról szóló megállapodáshoz való csatlakozásáról aláírt jegyzőkönyv értelmében a schengeni vívmányok azon rendelkezéseinek továbbfejlesztését képezi, amelyek az 1999/437/EK határozat 1. cikkének A. pontjában említett terület alá tartoznak, összefüggésben az említett jegyzőkönyvnek az Európai Unió nevében történő aláírásáról és egyes rendelkezéseinek ideiglenes alkalmazásáról szóló 2008/261/EK tanácsi határozat [7] 3. cikkével.

(11) Ez a határozat a schengeni vívmányok azon rendelkezéseinek továbbfejlesztését képezi, amelyeknek alkalmazásában az Egyesült Királyság, a Nagy-Britannia és Észak-Írország Egyesült Királyságának a schengeni vívmányok egyes rendelkezéseinek alkalmazásában való részvételére vonatkozó kéréséről szóló, 2000. május 29-i 2000/365/EK tanácsi határozattal [8] összhangban nem vesz részt; ennélfogva az Egyesült Királyság nem vesz részt ennek a határozatnak az elfogadásában, az rá nézve nem kötelező és nem alkalmazandó.

(12) E határozat a schengeni vívmányok azon rendelkezéseinek továbbfejlesztését képezi, amelyeknek alkalmazásában Írország, az Írországnak a schengeni vívmányok egyes rendelkezéseinek alkalmazásában való részvételére vonatkozó kéréséről szóló, 2002. február 28-i 2002/192/EK tanácsi határozattal [9] összhangban nem vesz részt. Ennélfogva Írország nem vesz részt ennek a határozatnak az elfogadásában, az rá nem kötelező és nem alkalmazandó.

(13) Ciprus tekintetében ez a határozat a 2003. évi csatlakozási okmány 3. cikkének (2) bekezdése értelmében a schengeni vívmányokon alapuló, illetve azokkal egyéb módon összefüggő jogi aktus.

(14) Ez a határozat a 2005-ös csatlakozási okmány 4. cikkének (2) bekezdése értelmében a schengeni vívmányokon alapuló vagy azokkal egyéb módon összefüggő jogi aktus,

ELFOGADTA EZT A HATÁROZATOT:

1. cikk

A schengeni konzultációs hálózat (technikai előírások) 1., 2., 3. és 4. része az I., II., III. és IV. mellékletnek megfelelően módosul.

2. cikk

Ez a határozat az Európai Unió Hivatalos Lapjában való kihirdetését követő huszadik napon lép hatályba.

Ezt a határozatot 2010. április 5-től kell alkalmazni.

3. cikk

Ennek a határozatnak a tagállamok a címzettjei a Szerződéseknek megfelelően.

4. cikk

Ezt a határozatot az Európai Unió Hivatalos Lapjában ki kell hirdetni.

1. az 1.1.2. pontban az utolsó albekezdést el kell hagyni.

2. az 1.1.3. pont első albekezdésének helyébe a következő szöveg lép:

"The application developed by each Member State reads delivery notifications from the inbox — on the basis of FORM R — and checks whether there is a corresponding delivery notification (FORM R) for every sent A, B, C, E, F, G or H form, which contained the "Document unifier". The "Document unifier" is a unique context string — which identifies the mail — in the line beginning with the numbers "000".";

3. az 1.1.3. pont negyedik albekezdésének helyébe a következő szöveg lép:

Norway’s central authorities are to ensure that necessary consultations of the other States take place. The absence of a reply within seven (7) days shall mean that the consulted State(s) has(have) no grounds for objecting to the issuing of the visa. If the represented State (Sweden) wants to be involved this has to be laid down in a bilateral representation arrangement between the States involved (Norway and Sweden). In that case, the represented State must always reply to the representing State's FORM F using a FORM G (obligation to reply). A visa cannot be issued if no reply indicating consent is received. The represented State may specify on the FORM G reply, that a Visa of Limited Territorial Validity (VLTV) should be issued in the framework of representation. In this case, all other Schengen States are duly notified (by means of a FORM C) of the VLTV's issued by the representing State. It is not necessary to state the territory to which the visa is limited.

Sweden’s central authorities are to ensure that necessary consultations of the other State(s) take place. The absence of a reply within seven (7) days shall mean that the consulted State(s) has(have) no grounds for objecting to the issuing of the visa. The represented State must always reply to the representing State's FORM F using a FORM G (obligation to reply). A visa cannot be issued if no reply indicating consent is received. The represented State may specify on the FORM G reply, that a Visa of Limited Territorial Validity (VLTV) should be issued in the framework of representation. In this case, all other Schengen States are duly notified (by means of a FORM C) of the VLTV's issued by the representing State. It is not necessary to state the territory to which the visa is limited. The consultation procedure (7 calendar days) and any further communication between the represented State and representing State in relation to the decision process (e.g. exchange of forms F and G) has to be done within 15 calendar days in accordance with Article 23(1) of the Visa Code.";

Heading No. 047: Reference of error message | Format: alphanum (19) |

The purpose of this heading is to identify the error message:

3 bytes identifying the sending State

16 bytes for the national identification number

Heading No. 048: Document reference (erroneous form) | Format: alphanum (19) |

This identifies the document the error refers to.

It contains one of the following headings of a referred form:

- "Reference number of request", (heading 001 of a referred "A" or "F").

- "Reference number of reply", (heading 040 of a referred "B" or "G").

- "Reference of the decision", (heading 044 of a referred "C" or "H").

Heading No. 049: Type of form | Format: code (1) |

Possible indications:. "A", "B", "C", "F", "G" or "H".

Heading No. 050: Type of error | Format: code (1) |

This heading indicates the error causing an E Form to be sent. The following codes can be used:

"1" technical error

"2" logical error

Heading No. 051: Reason for the technical error | Format: num (3) |

If error code 1 appears under heading No. 050, the number of the heading of the document which contains the first error must compulsorily be entered under heading No. 051.

Heading No. 052: Reason for the logical error | Format: code (2) |

If error code 2 appears under heading No. 050, the reason for the error shall be entered, according to the following codes:

"01" Reply received too late

"02" No consultation/information required

"03" Reply was not taken into account since visa of limited territorial validity has been issued in the meantime

"04" Form received in duplicate

"05" Unknown which form was received

The national applications shall be adapted in such a way that the statistics generated on Form E enable distinction of the number of error messages caused by technical errors (code = "1" under Heading No. 050) and logical errors (code = "2" under Heading No. 050).

Additional rule for form E:

It is prohibited to scan a form E itself for logical or technical failures and to reply to a malformed E by another form E to prevent a cumulative process – "Snowball Effect".";

11. a 2.1.10. pontban az "Additional rules for form R" alpontban a második alpont helyébe a következő szöveg lép:

"If a Member State receives an alleged erroneous form R, it has to discard this form R without processing it. This means that the Member State should ignore forms R that seem to be invalid. Consequently an application which had to discard potentially malformed forms R will have remaining, unacknowledged forms A,....., H which will have to be resent until a valid form R arrives. If the problem persists it has to be solved bilaterally by technical staff.";

When the national application has received the form it shall prepare an "R" form in order to acknowledge the form of type "A, B, C, E, G, F and H" (each document that contains a line that starts with ′000.′) that was received.

The structure of the "R" form is described in 2.1.10 FORM R: "DELIVERY NOTIFICATION"

The "R" Form is to be prepared and transmitted in direct connection to the reception of the form of type "A, B, C, E, G, F or H".

The procedure for preparing, sending and retrieving the "R" Form is otherwise the same as described in steps 1, 2 and 3 above for the normal forms.".
