Corrigendum to Commission Decision 2004/428/EC of 29 April 2004 amending Decision 2003/493/EC as regards the points of entry through which Brazil nuts in shell originating in or consigned from Brazil may only be imported into the Community

Decision 2004/428/EC should read as follows:

of 29 April 2004
amending Decision 2003/493/EC as regards the points of entry through which Brazil nuts in shell originating in or consigned from Brazil may only be imported into the Community

THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Regulation (EC) No 178/2002 of the European Parliament and of the Council of 28 January 2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety (1), and in particular Article 53 (1)(b) thereof,
Having regard to the Treaty of Accession of the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia, and in particular Article 2(3) thereof,
Having regard to the Act of Accession of the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia, and in particular Article 57(2) thereof,
Whereas:

Commission Decision 2003/493/EC of 4 July 2003 imposing special conditions on the import of Brazil nuts in shell originating in or consigned from Brazil (2) listed in its Annex II the points of entry through which Brazil nuts in shell originating in or consigned from Brazil may only be imported into the Community. |

(2) |
The list of points of entry must be adapted by reason of accession of the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia to the European Union. |

(3) |
It is necessary to update the list of points of entry for Germany, United Kingdom, Luxembourg and Sweden through which the products concerned by Decision 2003/493/EC may be imported. |
|
(4) |
Decision 2003/493/EC should therefore be amended accordingly, |
|
(5) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
HAS ADOPTED THIS DECISION:
Article 1
Annex II to Decision 2003/493/EC is replaced by the Annex to this Decision.
Article 2
The Decision shall apply from 1 May 2004.
Member States shall take the measures necessary to comply with this Decision. They shall inform the Commission thereof.
Article 3
This Decision is addressed to the Member States.
