COMMISSION IMPLEMENTING REGULATION (EU) 2026/2346
of 23 October 2026
making imports of silicon originating in the People’s Republic of China subject to registration
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union (1) and in particular Article 14(5) thereof,
After informing the Member States,
Whereas:
1. PRODUCT SUBJECT TO REGISTRATION
|
(1) |
The product subject to registration (‘the product concerned’) is silicon, a non-metallic chemical element with symbol ‘Si’ and atomic number 14, originating in the People’s Republic of China. |
|
(2) |
The product is currently classified under CN code 2804 69 00 (silicon containing less than 99,99 % by weight of silicon). This CN code is given for information only and without prejudice to a subsequent change in the tariff classification. |
2. MEASURES IN FORCE AND THE REQUEST FOR THEIR REVIEW
|
(3) |
The measure currently in force with regard to the product concerned is a definitive anti-dumping duty imposed by Commission Implementing Regulation (EU) 2022/1394 (2) on imports of silicon originating in the People’s Republic of China, as extended to imports of silicon consigned from the Republic of Korea and from Taiwan. |
|
(4) |
On 1 September 2026, the European Commission (‘the Commission’) announced, by a notice published in the Official Journal of the European Union (3), the initiation of an interim review under Article 11(3) of Regulation (EU) 2016/1036 of the anti-dumping measures applicable to imports into the Union of silicon originating in the People’s Republic of China. |
|
(5) |
This initiation followed a request submitted on 8 July 2026 by Euroalliages (‘the applicant’) on behalf of producers representing 100 % of the Union industry. In the request, the applicant provided sufficient evidence that, due to changes in circumstances of a lasting nature, the measures at the existing levels no longer offset the effects of injurious dumping as established in the Regulation (EU) 2022/1394. |
3. REGISTRATION
|
(6) |
The request for the initiation of an interim review investigation contained sufficient information that, as a result of change in circumstances of a lasting nature, the continued imposition of the measures at the existing levels no longer offsets the effects of injurious dumping as previously established. In particular, the applicant argued that, due to the overcapacities built up, Chinese imports have increased significantly in terms of volumes and market share at injurious price levels, thereby causing material injury to the Union industry. |
|
(7) |
In view of the above circumstances, considering the fact that the applicant provided sufficient evidence that due to changes in circumstances of a lasting nature the measures at the existing levels no longer offset the effects of injurious dumping as previously established, as well as the risk of further increases in imports following the initiation of the interim review, the Commission has decided to make imports of the product concerned subject to registration on its own initiative under Article 14(5) of Regulation (EU) 2016/1036. The purpose of registration is to collect sufficiently detailed data on imports taking place after the investigation period with a view to adequately informing the action needed to restore the effectiveness of the measures imposed by Regulation (EU) 2022/1394. |
|
(8) |
The Commission does not find it appropriate at this time to provide an estimated amount of future liability. |
4. PROCESSING OF PERSONAL DATA
|
(9) |
Any personal data collected in the context of this registration will be treated in accordance with Regulation (EU) 2018/1725 of the European Parliament and of the Council (4), |
HAS ADOPTED THIS REGULATION:
Article 1
1. The customs authorities are hereby directed, under Article 14(5) of Regulation (EU) 2016/1036, to take the appropriate steps to register imports into the Union of silicon, a non-metallic chemical element with symbol ‘Si’ and atomic number 14, currently classified under CN code 2804 69 00 (silicon containing less than 99,99 % by weight of silicon), and originating in the People’s Republic of China.
2. Registration shall expire nine months following the date of entry into force of this Regulation.
Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
Done at Brussels, 23 October 2026.
For the Commission
The President
Ursula VON DER LEYEN
