DECISION OF THE EEA JOINT COMMITTEE

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 133/2005 (1).

(2)

Regulation (EC) No 648/2004 of the European Parliament and of the Council of 31 March 2004 on detergents (2) is to be incorporated into the Agreement.

(3)

Regulation (EC) No 648/2004 repeals Council Directives 73/404/EEC (3), 73/405/EEC (4), 82/242/EEC (5), 82/243/EEC (6), 86/94/EEC (7) and Commission Recommendation 89/542/EEC (8), which are incorporated into the Agreement and which are consequently to be repealed under the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XV of Annex II to the Agreement shall be amended as follows:

1.

the following point shall be inserted after point 12t (Commission Regulation (EC) No 642/2005):

‘12u.

 32004 R 0648: Regulation (EC) No 648/2004 of the European Parliament and of the Council of 31 March 2004 on detergents (OJ L 104, 8.4.2004, p. 1).’;

2.

the texts of points 2 (Council Directive 73/404/EEC), 3 (Council Directive 73/405/EEC), 7 (Council Directive 82/242/EEC) and 13 (Commission Recommendation 89/542/EEC) shall be deleted.

Article 2

The texts of Regulation (EC) No 648/2004 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 3 December 2005, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
