DECISION OF THE EEA JOINT COMMITTEE

amending Annex XX (Environment) to the EEA Agreement
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,
Whereas:

Annex XX to the Agreement was amended by Decision of the EEA Joint Committee No 125/2006 of 22 September 2006 (1). |

(2) |
Directive 2006/11/EC of the European Parliament and of the Council of 15 February 2006 on pollution caused by certain dangerous substances discharged into the aquatic environment of the Community (Codified version) (2) is to be incorporated into the Agreement. |

(3) |
Directive 2006/11/EC repeals Directive 76/464/EEC (3), which is incorporated into the Agreement and which is consequently to be repealed under the Agreement, |
HAS DECIDED AS FOLLOWS:
Article 1
The text of point 4 (Council Directive 76/464/EEC) of Annex XX to the Agreement shall be replaced by the following:
‘32006 L 0011: Directive 2006/11/EC of the European Parliament and of the Council of 15 February 2006 on pollution caused by certain dangerous substances discharged into the aquatic environment of the Community (Codified version) (OJ L 64, 4.3.2006, p. 52).
The provisions of the Directive shall, for the purposes of this Agreement, be read with the following adaptation:
The following shall be added after the first paragraph of Article 13:
“The time limit for transposition into national law for Directive 2000/60/EC set out in Part B of Annex II shall not apply and shall be replaced by the date of entry into force of the Decision of the EEA Joint Committee incorporating Directive 2000/60/EC into this Agreement.”’
Article 2
The texts of Directive 2006/11/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 28 April 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (4).
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
