The sitting opened at 17.05.
2. Approval of Minutes of previous sitting
The Minutes of the previous sitting were approved.
3. Statement by the President
The President made a statement on the 60th anniversary of the United Nations and mentioned the summit of Heads of State and Government that had been held in New York on 15 and 16 September 2005.
4. Tribute
On behalf of Parliament, the President paid tribute to the memory of Matti Wuori, a Member of Parliament during the previous parliamentary term, who had died on 15.10.2005.
5. Membership of Parliament
Garrelt Duin and Ingo Schmitt had been elected to the German Bundestag with effect from 18.10.2005. Under Article 7(2) of the Act concerning the election of Members of the European Parliament by direct universal suffrage, Parliament noted that this office was incompatible with that of Member of the European Parliament and established the vacancy of the seats concerned with effect from that date.
At its sitting of 13.10.2005(Minutes of 13.10.2005, Item 11), Parliament had established the vacancy of Wojciech Wierzejski's seat with effect from 19.10.2005, as Mr Wierzejski had been elected to the Polish Parliament. The Polish authorities had later informed the President that, under Polish law, the office of Member of the European Parliament became incompatible with that of Member of the Polish Parliament upon publication of the election results, not on the day of the Polish Parliament's inaugural sitting. As a result, it was deemed that the vacancy of Wojciech Wierzejski's seat had taken effect as of 7.10.2005.

In addition, the Council had informed Parliament that it had approved:

In light of the modifications that had been made by the Council to the text transmitted to the Parliament, the President had consulted the ENVI committee, as the committee responsible, under Rule 66(2). Since the ENVI committee was not able to accept the modifications made by the Council, the Council held to the position adopted by Parliament. The President announced that he would thus also sign that act on Wednesday.
12. Order of business
The next item was the order of business.
The final draft agenda for the sitting of October (PE 364.061/PDOJ) had been distributed. The following changes had been proposed under Rule 132:
