Explanatory Notes to the Combined Nomenclature of the European Union

Pursuant to Article 9(1)(a) of Council Regulation (EEC) No 2658/87 (1), the Explanatory Notes to the Combined Nomenclature of the European Union (2) are hereby amended as follows:

On page 413, the following explanatory note is inserted:

9504 40 00 Playing cards

This subheading includes typical playing cards that require an interaction between the cards themselves, such as pairing, exchanging or using and combining the cards to form words, groups of symbols or rows of numbers (for example, bridge cards, poker game cards, lexicon cards, tarot cards and phantasy playing cards). This subheading also includes memory playing cards and other similar playing cards, usually played so that the same colours, values, symbols or images have to be paired.

Other types of card games where the cards contain knowledge questions, tasks, quizzes, pictures or answers to these questions (whether or not in a set with other playing instruments, for example, a dice or an hourglass) are however not considered playing cards of this subheading. The players only have to reply to a question, fulfil a task or, for example, guess who is shown in the picture on a card and their way of playing does not require an interaction between the cards. These cards have the objective characteristics of other parlour games and are thus to be classified under CN code 9504 90 80 as other games.’
