DECISION OF THE EEA JOINT COMMITTEE
No 6/2007
of 27 April 2007
amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,
Whereas:

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 43/2005 of 11 March 2005 (1). |

(2) |
Directive 2006/42/EC of the European Parliament and of the Council of 17 May 2006 on machinery, and amending Directive 95/16/EC (recast) (2), as corrected by OJ L 76, 16.3.2007, p. 35, is to be incorporated into the Agreement. |

(3) |
Directive 2006/42/EC repeals Directive 98/37/EC (3) which is incorporated into the Agreement and which is consequently to be repealed under the Agreement with effect from 29 December 2009, |
HAS DECIDED AS FOLLOWS:
Article 1
The following shall be added in point 5 (European Parliament and Council Directive 95/16/EC) of Chapter III of Annex II to the Agreement:

Article 2
Chapter XXIV of Annex II to the Agreement shall be amended as follows:

the following point shall be inserted after point 1b (Directive 2000/9/EC of the European Parliament and of the Council):

2. |
the text of point 1 (Directive 98/37/EC of the European Parliament and of the Council) shall be deleted with effect from 29 December 2009. |
Article 3
The text of Directive 2006/42/EC, as corrected by OJ L 76, 16.3.2007, p. 35, in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 4
This Decision shall enter into force on 28 April 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (4).
Article 5
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
