DECISION OF THE EEA JOINT COMMITTEE

of 27 April 2007

amending Annex XIII (Transport) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex XIII to the Agreement was amended by Decision of the EEA Joint Committee No 155/2006 of 8 December 2006 (1).

(2)

Directive 2004/36/EC of the European Parliament and of the Council of 21 April 2004 on the safety of third-country aircraft using Community airports (2) was incorporated into the Agreement by Decision of the EEA Joint Committee No 152/2005 (3) of 2 December 2005, with country specific adaptations.

(3)

Regulation (EC) No 1592/2002 of the European Parliament and of the Council of 15 July 2002 on common rules in the field of civil aviation and establishing a European Aviation Safety Agency (4) was incorporated into the Agreement by Decision of the EEA Joint Committee No 179/2004 (5) of 9 December 2004, with specific adaptations.

Commission Regulation (EC) No 768/2006 of 19 May 2006 implementing Directive 2004/36/EC of the European Parliament and of the Council as regards the collection and exchange of information on the safety of aircraft using Community airports and the management of the information system (6) is to be incorporated into the Agreement.

The adaptations foreseen with regard to Regulation (EC) No 1592/2002 should, where applicable and unless otherwise provided, apply mutatis mutandis to other Community legislation conferring powers on the European Aviation Safety Agency and incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Annex XIII to the Agreement shall be amended as follows:

1.

the following point shall be inserted after point 66r (Directive 2004/36/EC of the European Parliament and of the Council):

‘66ra.

32006 R 0768: Commission Regulation (EC) No 768/2006 of 19 May 2006 implementing Directive 2004/36/EC of the European Parliament and of the Council as regards the collection and exchange of information on the safety of aircraft using Community airports and the management of the information system (OJ L 134, 20.5.2006, p. 16).’;

2.

the following adaptation text shall be added in point 66n (Regulation (EC) No 1592/2002 of the European Parliament and of the Council):

‘(s)

Where applicable, and unless otherwise provided, the above adaptations shall apply mutatis mutandis to other Community legislation conferring powers on the European Aviation Safety Agency and incorporated into this Agreement.’

Article 2

The text of Regulation (EC) No 768/2006 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 28 April 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (7).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
